3 grade levels behind and school in denial

So my neice has had a tough life to say the least. Long back story, depressed mom, deadbeat dad, angry ex step dad, spent 2 years in homeless shelter, also lived with her 2 brothers and mom in nana's 2 bedroom condo. All things that SHOULD raise flags. School know when they were in the shelter, there is extra funding for teaching homeless kids. Well would LOVE to know WHERE that money was spent.
Since the begining with all my sisters faults she did question neice progress. And she was up front asked when she didn't understand the math homework she would get what services were aviable and the response oh she is doing fine. My mom asked too. They just knew things didn't add up but year after year she passed to next grade and everytime they would ask "oh she is such a joy" Well 6th grade comes new school first quarter and she is failing 2 subjects in danger in 2 more. So the school does sort of like an IEP meeting for all kids. Its not about special ed but they get all the kids teachers and have like a team meeting with the parents. Like a parent night but all the teachers are in one place. So sister has a case worker and she comes with her since they had already gotten the first report card and still in failing 2 subjects close in 2 others the school was refusing there could be SOMETHING going on. The case worker basically refused to leave until they agreed to test her and guess what she is at 3rd grade level in just about everything.
The lady who did the testing has been great even offering to tutor at no cost at home. The superintendant also happens to live in my mom's building and we have known his since I was kid. My mom hates going to him but decided he needs to know. She wasn't complaining whats done is done we can't go back have to go foward BUT he needs to know this happened because there are probably more kids and he was livid to hear and upset they didn't go to him earlier and he is getting the ball rolling for more intervention for her. She is in a title 1 school now (wasn't before) so we are hoping they can get her more services at the cities expense. She is in total denial but more moodier then ever she told school councler its ok she is used to be forgotten (Oh God that one hit aunty guilt...i had my own kids did less with her but not earler sister got married at that time so while DH and I used to take her to his family holiday functions she had a new family at the time but aunty guilt and all did I do enough after sister divorced him). They all do family counceling and now they want her to get a more in debt evaluation. And of course sister feels guilty.
Guess she is a prime example that NCLB isn't working and our state constantly BRAGS about education!!
