Thanks! I think that the mom will need to take it up with the school. He is kind of in a catch 22. The "local" contracted OT can only meet with him in the evenings (dinner time) or on weekends. Which leads to issues for him for dinner and low blood sugar (he is autistic - he needs a stable schedule - he does not adapt like normal kids), and free time that impacts when he gets to spend with non-custodial dad. His IEP was amended to ensure that his therapy is within normal hours, but the only OT available is that hour away, and their time is limited when they can see him during the day. From what you say, he would be expected be able to rearrange his schedule and still get everything done, except that his disability is autism and he needs a fixed schedule that has schoolowork during certain hours every day.
