I believe this is illegal but I have nothing to back it up, if I am right please give me something if you can so that I can back it up.

I am not sure. I do know that m oldest was in what is called Langage Science in our district and he didn't have to make up any work missed.His out class for dyslexia was at a time he didn't miss anything. He went during reading as that is where his reading grade came from. Does your son go everyday?Does he receive a reading grade from his gened class? I realize that you aren't trying to get your kiddo out of any work, just making sure he isn't doing extra work that he may not have to do. I would have a talk with his teacher and the dyslexia teacher. As far as being illegal I am not sure of that. I will say this my oldest is 16 and is able to read grade level books which for him is 10th grade. Hugs Dawn

My ODD was in special ed all morning and then a regualr class in the pm. She often had homework come home that the class had done while she was away...but ONLY if it was something that she had done during in class time too. That way she wasnt falling so far behind.

I dont know if its illgeal. It seems like if he was given in class time also, then it becomes the same as any othe rincompleted classroom projects.

I guess the reason I said illegal is b/c in the county district kids are not held accountable for work missed in the gen. ed. room while they are out for special services. In that school system the teachers are not allowed to do it so I just assumed it was the same everywhere.

I believe he is getting his reading grade from the special ed. teacher and the gen ed. teacher but most of his reading time is spent w/ the special ed. teacher. He generally follows the same story as the rest of the class but the SPED teacher tailors it to him and his level. If the story is too much for him though she does supplement it for another one.

Yes I asked my sister and she was the one that told me that in their district the children were not held responsible for work missed in the Gen ed. classroom while they were in SPED. It was not allowed in their district. I do not have anything like that in his IEP about homework. They said at the beginning of the year that the children should not spend more than 40mins a night on homework and if they did then they were not completeing things in class. I really find this odd b/c I know of other children (not just my son who is in SPED) who are spending more than 40 mins a night on homework.

Yes he did get time in class to do it but my issue was that he didn't have the same amount of time in class to do it as the rest of the kids. He did the work last night and did very well on it and it didn't take him much time. (thank heavens) So it went well this time. I just worry if other times will arise when he didn't have the same amount of time as the others due to his SPED services and he will be overrun w/ the classwork and the homework.
