Your son sounds a lot like mine. My DS is 9 going into 4th grade and in the pull-out program for math. This is the only program they currently offer. He has also had some issues with the teacher who doesn't seem to understand or deal well with ADHD. I would have pulled him out but then he would basically be repeating a year of math this coming year. Boredom can lead to behavior problems in itself. My son too has this teacher for two more years.
I would ask to meet with the Child Study Team (or similar) asap to formalize a plan in writing. He may be eligible for a 504 plan or a behavior intervention plan. Obviously, whatever the teacher is doing now isn't working too well if he received a "D" in behavior. Sounds like you've already begun the process with the psychoeducational evaluation that was started last year. HTH.
