Hey all, funny IEP question and looking for oppinions. I have an IEP for Mike tomorrow and this will come up as his BIP (Behavior intervention plan) is on the agenda.
Here is the thing. At the beginning of 3rd grade (we are now end of 5th) Mike had a functional assessment and BIP written. I did NOT agree with the FAA at the time but did agree to give her ideas a try. Her ideas failed and the district agreed to give me an independent assessment. Well we had trouble finding someone qualified to do the independent assessment and in the meantime Mike's teacher did a wonderful job and figured it all out on her own and created some behavior support plans for Mike but always wanted to keep a BIP open incase she needed the help of a trained BICM (Behavior Intervention Case Manager). Well, time slipped by and the ball was dropped on the independent FAA by both myself and the school.
Because Mike is transitioning to a new school we are meeting tomorrow to rewrite all his behavior stuff to make sure it is current and we are addressing the BIP issue.
Here is the question. We still have this completely inaccurate Functional Analysis that is nearly 3 years old. I don't feel we need a new one at this point (the diagnostic center one covered this) but I want the old one removed from his records.
Has anyone gone about getting a report removed from your childrens records? I don't want to be 3-6 years down the line and suddenly someone pulls this piece of crap up from the history again.

Sorry. I have no experience of this. I would imagine you woudl have to prove it is a complete pile of poo before you can get it removed, and that might be hard to do.
Have you asked your DH for ideas about this?

I don't have any experience with this either. I do recall Steph, on the IEP board, talking it about it though. Maybe you can search over there.
I remembered what the law is called, FERPA. Here is the section about getting something removed:
Parents or eligible students have the right to request that a school correct records which they believe to be inaccurate or misleading. If the school decides not to amend the record, the parent or eligible student then has the right to a formal hearing. After the hearing, if the school still decides not to amend the record, the parent or eligible student has the right to place a statement with the record setting forth his or her view about the contested information.

NOT my area of expertise, but if there is ever a problem, seems to me all you have to do is ask to have it redone/updated for an older kid! Even if it were a good and workable plan, it must be out-of-date by now. There are lots of things in my son's file from when he was younger that no longer apply, as he has developed. This BIP is old.
And anyways, if anyone tried to bring it back up, you are part of the team and can put the ole kibosh on it at that time, so no implementation. I guess I would worry about it when there needs to be worrying. The school he is going to for middle school may be so right for him that there is never any need to even think of it!!! Right?
Maybe you want to add a letter to his file strongly objecting to the plan and listing the reasons it didn't work, documenting, as it were.
