So we are filing for an impartial hearing. Ever since we heard that this decision by State of New York was aimed at removing special ed home services for home school students, there has been a battery of online emailing from other parents in the same boat as we are, and now we hear that several of them have filed for emergency pendency impartial hearings, arguing that the services should continue under "stay-put" until an appropriate placement can be found. This is using our own little loophole that no one is talking about, the fact that there ARE no appropriate placements available, even inappropriate placements for Malcolm are full up so they can look and look, but we are free and clear. And of course, if the DOE actually came up with an appropriate placement, that would be what is known in some circles as ... a MIRACLE!
One parents already won, another won't hear results for a few weeks. There is no policy in place and each district is using different arguments, as NYC's immediate removal of services was a knee-jerk reaction to State ruling, other school districts around the State have at least extended the services through rest of this school year DUH! This should at least be interesting, and keep me from being bored, as Gawd knows we don't want Sara to have too much free time on her hands, Devil's playground and all that!!!!
Impartial Hearing office should be getting our request tomorrow and we'll see what happens. More as the story unfolds,

Good for you! I would certainly think you have a case since you've had such a problem finding an appropriate placement! and it's not for you not trying-- be sure you bring the list of all the schools you've applied to and interviewed with.

Hmmm. Fighting it on the 'in-place' rule is a good idea, especially for a Spectrum kid because we all know how much they love change.
Hopefully something good will come of all this; the city will have to do something to support the special needs kids who have suddenly been left out in the cold, and maybe they will start to put some credible programming together. Of course, the timing will be everything, and I know you and DH don't have much of it.
I am hoping beyone hope that int he meantime, a good place will open up for him in one of the private schools, and your life can return to abnormal.

Don't forget. Right now the political environment up in Albany just changed this past couple of weeks. So maybe with everybody trying to play nice in the amidst of scandal may be in your favor. Plus our new Governor comes from Long Island and was a State Senator from Harlem/ So maybe things may swing in the other direction. Maybe Spitzer misfortune could be your silver liner
