Been a while I know, we were away in Ireland for a week and have been trying to back into the swing of things since then.

Dee, I am really sorry. That sounds so frustrating. I would strongly recomend requesting an independent assessment and going to see Steph on the IEP board.
As for the tears, behavior, oppositionality, behavior is communication for kids who aren't effective communicators. The behavior isn't just because he is BP, or because he is a naughty kid, or hasn't had consistent consequences (yes I have heard this one myself, don't know if they hit on that yet), but rather it is because all is not right in his little world. Whether it is sensory or some other issue, his behavior should be saying to them that what they are doing is not working for him and they need to make the change and try harder. Particularly at his little age. UGH!
Definitely as for a functional behavior assessment, and if they are insisting he doesn't need OT and you believe that is the cause of his problems and don't agree with thier assessement, then ask for an independent one at their expense/

Good to "see" you again. I agree with Renee that it would be good to get some help, Steph at IEP Board is great. You will need to fight for what your son needs! And isn't that just exhausting, how we have to fight for what our kids have a legal right to every single step of the way!! An independent IEE seems very warranted. Getting a partner in an advocate and/or lawyer might not hurt either, or at least you should start looking into this option in case you need to.
So often mild spectrum is mis-dx'ed adhd and even bi-polar because the behaviors which come from the sensory difficulties and translation problems of spectrum LOOK so much like the other. Then the proof that it ISN'T adhd comes when the appropriate drugs are used and the kids have horrible reactions. All so scary. And isn't it appalling how cavalier the medical communite and educational system is with experimenting on our kids in order to figure out what will work...
Anyways, in the long run, what is a little appearance of pushy and control freak when the things the school are doing to our kids can be actually harming them. And hardly educating them. At least in anything we want them to know about, like how little they seem to be capable to do what is required of them without appropraite support...

Good to see you back. I'm sorry things have been so tough. I agree with everything the others said IEE and all that. I also think the school OT's only competence is buck passing, as observation skills and knowledge of sensory kids both seem completely lacking. She must have some skill... Maybe she is great at flower arranging? Did you happen to notice any particularly nice arrangements in the school? (and if you do, compliment her on them!)
Seriously. Just because SID may be impacted by BP does not mean you ignore it. I can totally see how a BP kid would be inconsistent in his sensory responses. In a manic/hypomanic state, with mood up; sensory issues will be less of a problem (because we all know stress is the big trigger) or he will appear to care less about them. However, n a downswing... SID central. How can any logical person not see that?
It's a pity we are not still running the "Golden Crock" awards, becaause that one is a deninite candidate.
