My 10yr old son got in a fight at school

Hi all,
Well my son was suspended from Tues until today because him and another little boy got in a fight at school. This little boy has been calling my son names all year like - You're not a gentleman you're a mental man and I guess my son just got to his boiling point. It started as a food fight in the cafeteria and then escalated to pushing, and shoving. The principal did complement my son for his honesty because they have to write down the incident and what happened and she said she's seen alot of growth in him since last year. she said it's the most she's been able to ever communicate with him. He just got his Aspergers diagnosis a couple of weeks ago and they are setting up the different modifications and help at school. Anyone else have an Aspergers child who has a hard time dealing with anger? Any coping mechanisms? He also has a younger brother that is a bit of a pain...as younger bros can be and tends to snap on him sometimes- luckily the little one has only gotten hurt a couple of times but I want to work on this anger stuff before it gets out of hand.
Thanks,
Amy

I will def look into getting that book. I'll add it to my neverending list of good books to read. LOL
I will also ask for a behavior support plan. The principal is out until Monday so it will give me some time to get a plan of action together. I feel like they say all these nice things during the meeting for the IEP but things aren't being followed thru on.
He does have an IEP but when they tested him they said his behavior didn't warrant any need for modifications...yeah right. He was suspended like 3-4 times last year and already one time this year. I just don't get it.
I didn't quite understand your last paragraph. I somewhat looked into the wrightslaw webpage but there's so much info on there....i don't have alot of time right now. I had to bring my 3mo old to the doctor and found out she has bronchitis!! So I'm dealing with that right now too. Did you mean, that with an IEP he SHOULD be protected from being suspended, if it's included in there somehow?
Thanks for all the suggestions.

Yes, under IDEA if a child has an IEP when they are suspended it is kind of an emergency thing to kind of make a safe environment and then a meeting should be held right away to determine what happened, what to do next time.
They CANNOT suspend more than 10 days within a year without holding what is called a manifestation determination. That is to see if the behavior is a manifestation of thier disability. If it is then they must go through the proper procedures to try to rectify it or in other words behavior support plan, or behavior intervention plan if more severe.
I know I am getting alot of my stuff mixed up. There was some changes in the new IDEA but the spirit is still the same, they cannot just suspend a child with a disability in the same manner they do other kids. They can still be suspended however, there are more safeties in place and accomodations and work need to be done to help the child to be successful in school.
I really have to look up the whole thing again myself or you can ask Steph on the IEP board. I know she can spit out the whole thing like her ABC's most likely. I would have to look it up and I don't have time today either.
