Steph (ya know, the IEP guru) informed me that they can't just deny an IEE. Seems they have to either grant me the IEP or file for due process and prove thier eval was acceptable.

However, it is touch and go if I would win. Though the report is for crap, the actual test numbered results aren't all that incorrect. However, since they already denied once and I just sent them a nice little certified letter informing them of thier major goof, I have a feeling they won't push the due process thing.

If they do then I will see what avenues I have to go to to get the report itself changed as well as filing a compliance complaint with the state over the IEE since they did an illegal thingie.

Where is my stilletos and fatigues girls. I have an IEP on Wednesday where they are going to try to deny her OT services and they should be getting thier letters just about then.

I don't feel like going into the IEP wednesday morning with this still hanging in the air. I couldn't get the certified letters out with the mail on Saturday so they are going out today. I am also going to drop a copy at school with a note that tells the teacher another is coming registered mail. That way at least the district knows where I stand before they try to pull more crap on me. I am getting the report today and if I have any incling that they will be turds, I am cancelling the meeting. I am tired of going in there alone to be attacked.

Couldn't sleep much at all last night. Hate this stuff. I am not fond of confrontations but will do it for the kids if I have too. Finally got to sleep and Dave wakes me up because of a bad dream and slept with us all night which means I didn't, so I am in a joyful mood today (NOT!).

does your local autism society have advocates that will attend an IEP meeting w/ you? Ours does and I've called for advice but I haven't actually had them come to a meeting. I do think having someone there that is on your side (not necessarily doing all the talking or anything) is really helpful and empowering. I dread the MS thing w/ Weston. I've been through it w/ Warren and his ADD/disgraphia/other health-asthma stuff, they are not easy to work with and even when we have had a good IEP that doesn't mean that the resource teacher or the classroom teachers actually follow it. I'm dreading MS for Weston.

I called regional center and they are going to get me an ed consultant for her. That is one of the MAIN reasons I keep thier regional center status even if I don't use most of their services anymore. They provide an educational consultant for free. They aren't advocates per se but they go with you to IEP's, they can observe in the classroom, make recomendations, give advice, etc.

My SIL has one who is rather well known in the area as a ball buster. I am tempted to ask for her specifically but even my DH hates her (from his district work).

There is this one advocate in the county who is total kick bu++. DH likes her because she is always right and knows what she is talking about but she takes no prisoners either. She scares DO people who don't know what they are doing.

Interesting note today. Was talking with Mike's program specialist (the one I like). I did mention this issue with the other PS and such. She did comment specifically that when it comes to decisions like IEE's, program specialists do not make that determination on thier own but rather it comes from above them. Well Glenn is the head guy for middle schools. The only one above him is the Director....soo.......I gotta get my fighting shoes on.
