Central Auditory Processing Issues

Hello, My son (going into second grade) was diagnosed with APD and I just met with the principal of his school today. It has been explained to me, that the school is not legally obligated to accommodate his disability because he is an excellent student. His auditory processing disorder is very significant as his evaluation showed his CAPD scores to be way out of normal range. The school says this is not a disability because he is an advanced student (based on standardized written test results and assessments). While written tests are not a problem for him, he cannot effectively participate in class dicussions and has difficulty following oral instructions. This is very stressful and frustrating for him.
Any advice on how to get some assistance for him at school? I hate the thought of him struggling through another school year, missing out on much of his teachers instruction.
Thanks so much for your help, BG
