DS is 4 and is in Junior Kindergarten, he goes on Mondays and Wednesdays and every other Friday; so he's been in class a total of 5 days.

((hugs)) isn't it heart breaking??? Logan has issues with a couple of kids at daycare, and so far I've tried telling me to tell his teacher right away (there are a couple kids who hit and still bite). Thankfully Logan is moving up to the older preschool room and leaving the younger ones behind.. but I know how boys are... Logan is very sensitive and gets very sad when someone is mean or whatever...

I would be tempted to talk to the teacher just so she's aware - sharing your concern over his emotional wellbeing. Maybe the teacher hasn't noticed? I would hope that if a child was wondering around not doing anything, that the teacher would interact with them and find out why.

I do agree with your DH about teaching your child to stick up for himself. I think being confident and assertive definiately scares off bullies. Maybe you can do role playing.. have your son share what the kid said that day... and then practice approapriate responses that might make him feel more confident knowing he doesn't have to listen - or worry about the bully not liking him.

My consern about DS being assertive is that it might get physical, and DS could get seriously injured, and I think other kids can easily notice that he can not defend himself (because of his condition).
