Detention for a Jolly Rancher?

I was just reading a news article about a third grader who got a weeks detention for accepting a Jolly Rancher from another student, because it goes against state laws that limit the amount of junk food in schools.

I think it is very wrong to give her detention for a Jolly Rancher.
