Katie Holmes Seeking Primary Custody of Suri: Report

New reports say Holmes wants custody of their 6-year-old daughter. Is a bitter legal battle in their future?

Let's hope that Tom Cruise and Katie Holmes won't be the next Hollywood couple to enter into a bitter custody battle.

On June 29, the shocking news broke that Holmes, 33, had filed for divorce from her husband of five years. And it didn't take long for reports to surface about her plans for their 6-year-old daughter, Suri. The actress is reportedly seeking "primary residential custody" of her daughter, asking for a "suitable amount" of child support from the actor, TMZ.com reports. 

Of course this news can only make the situation tougher for Cruise, 49. According to his rep, the Rock of Ages star was already devastated by the split. "Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children," the rep said in a statement. "Please allow them their privacy to work this out."

When the story first broke, Holmes' attorney offered up a brief statement about the split: "This is a personal and private matter for Katie and her family," he said. "Katie's primary concern remains, as it always has been, her daughter's best interest."

This was the first marriage for Holmes, who wed the actor in Italy in November 2006. However, it will be Cruise’s third divorce, having previously wed actresses Nicole Kidman and Mimi Rogers. (Cruise also has two older children from his relationship with Kidman.)
