UPDATE: Looks Lindsay Lohan may have had an extra "Get Out of Jail Free" card laying around!
Judge Stephanie Sautner ruled today that the alcohol tests that were given to Lohan last week were actually not a required part of her probation. Her terms required controlled substance testing from Jan. 3 to Feb. 25, 2011. At that time, her SCRAM bracelet was removed, and she was no longer required to submit to alcohol testing.
The judge added that the only thing Lohan was guilty of was "extremely poor judgment." Sautner then ruled that for the remainder of her house arrest, she's only allowed to have one friend in her home at a time. However, there will not be any more drug or alcohol testing -- so Lindsay (and her one friend) can booze it up all they want, as long as there is no driving involved!
It seems Lindsay Lohan has, once again, violated the terms of her probation and may be headed back to the slammer.
TMZ reports say that Lohan, 24, was administered two alcohol tests last week under the terms of her probation. She passed one but failed the other, which she took right after she hosted a rooftop barbeque at her home.
Lohan, who is currently on house arrest, is reportedly being called before the L.A. County Superior Court judge at 10 a.m. PST on Thursday morning to plead her case in yet another probation hearing. Sources tell TMZ that the probation department is fighting to get Lohan thrown back behind bars!
So could her latest legal woes be the reason that Lohan decided at the last minute to ditch an interview with Matt Lauer this week?
The Today show anchor flew to Los Angeles Tuesday for the scheduled interview at the troubled starlet's Venice condo. TMZ reports that Lohan was getting her makeup done in preparation for the chat but then abrubtly called it off after learning that Lauer wanted to interview her for much longer than the 15 minutes she expected.
"When [Lauer] arrived at her home, she had a change of heart and wasn't prepared to talk for more than 15 minutes as she had agreed, so the interview was canceled," said a Today show spokesperson.
Lohan's camp claims they simply weren't prepared for a lengthy sitdown, and her publicist, Steve Honig, informed Lauer that the interview was a no-go.
But NBC sources told TMZ that producers had, in fact, made it clear to Lohan and her reps before Lauer even left New York for the interview about his intentions. Still, somehow wires got crossed, and Lauer made the trip for nothing.
On Thursday's Today, Lauer addressed the issue right after they ran a report about Lohan's latest probation hearing.
"At the last minute, Lindsay and her people did express concerns about the timing of the interview and it was canceled," he said. "I think we're learning more this morning about the reasons for their concern."
Lohan is serving 35 days of house arrest after being convicted of stealing a necklace from a Venice jewelry store in January.
