The Martex Community Challenge Sweepstakes (the "Sweepstakes") is jointly sponsored by iVillage Inc. ("iVillage"), 500 Seventh Avenue, 14th fl., New York, NY 10018 and WestPoint Stevens, 1185 Avenue of the Americas, New York, NY 10036. (iVillage and WestPoint Stevens are referred to jointly herein as the "Sponsors" and all references to the Sponsor or Sponsors shall, unless otherwise indicated, be deemed to include both iVillage and WestPoint Stevens.) The Sweepstakes is open to legal residents of the 50 United States, including the District of Columbia, who are 18 years of age or older at time of entry.
1. HOW TO ENTER: There are two enter this sweepstakes:
ONLINE: Beginning 11:00am Eastern Time on January 5, 2004 through 11:00am Eastern Time on March 5, 2004 (the "Entry Period"), log on to http://www.ivillage.com/home/challenge/pages/0,,205975_417297,00.html and follow the on-screen entry instructions or click on the Martex Community Challenge Sweepstakes banner and follow the on-screen entry instructions. Entrants automatically receive one entry into the Sweepstakes by entering the Martex Get Organized Community Challenge during the entry period. By entering, you certify that you are 18 years of age or older and otherwise eligible to participate. Online entries must be received by 11:00am Eastern Time on March 5, 2004. Limit one entry per email address/per person/per household for the duration of the Entry Period. All eligible entries received are eligible for the random prize drawing conducted on the date specified in Rule #2. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. Automated, mechanical, or third party entry devices or services are prohibited.
BY MAIL: In the event that you do not wish to enter the Martex Get Organized Community Challenge, you may still enter the Sweepstakes by mail by sending a 3x5 card with your name, address, phone number, email address (if available), city, state, and zip code to: Martex Get Organized Sweepstakes, 500 Seventh Ave, 14th Floor, New York, NY 10018. Mail-in entries must be postmarked by March 5, 2004 and received by March 12, 2004. Unique entry is determined by unique name and postal address for mail-in entries. Limit one entry per email address/per person/per household for the duration of the Entry Period. All eligible entries received are eligible for the random prize drawing conducted on the date specified in Rule #2. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. Automated, mechanical, or third party entry devices or services are prohibited.
2. RANDOM DRAWING: One winner will be selected in a random drawing on or about March 17, 2004 from among all eligible entries received during the entry period. "Eligible Entries" are those entries received by iVillage throughout the Entry Period, which meet all eligibility requirements set forth in these Official Rules. Random drawing will be conducted by iVillage whose decisions are final and binding with respect to all matters related to the Sweepstakes. Winner will be notified by email/mail. Odds of winning will depend upon the number of eligible entries received.
3. PRIZE: Subject to verification and compliance with these Official Rules, one (1) Grand Prize Winner will receive: One Grand Patrician Geneva Bedding Ensemble (only available in queen or king) including one (1) comforter, one (1) Euro sham, one (1) fitted sheet, one (1) flat sheet, one (1) bed skirt; two (2) standard size pillowcases; two (2) standard size shams; one (1) coordinating 18" square pillow and one (1) coordinating breakfast pillow; one (1) Martex Embassy Heated Mattress Pad; one (1) Diamond Facets bath ensemble including four (4) bath towels in maize, four (4) hand towels in maize, and four (4) wash clothes in maize, one (1) lotion pump, one (1) tumbler, one (1) soap dish, one (1) toothbrush holder, one (1) waste basket, one (1) tissue box, one (1) set of shower rings and one (1) shower curtain (Estimate Retail Value is $758). No transfer, substitution or cash will be awarded in lieu of stated prizes except in Sponsors sole discretion. Sponsor may replace prizes with items of equal or greater value in the event stated prizes are unavailable. Prize is nontransferable, non-substitutable and non-endorsable. Limit one prize per person per email address per household.
4. GENERAL RULES: Open only to legal residents of the United States and the District of Columbia, who are 18 years of age or older at time of entry. Employees of WestPoint Stevens, iVillage, Inc., their respective parents, affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible to participate or win in the Martex Community Challenge Sweepstakes. Void where prohibited by law. No substitution or transfer of prize by winner permitted. All federal, state and local taxes are the sole responsibility of winner. All federal, state and local laws apply. All entries and materials submitted become the sole property of the sponsors and will not be acknowledged or returned. Potential winner may be required to sign and return an Affidavit of Eligibility/Release of Liability/Prize acceptance form within 7 days of attempted notification. Noncompliance within this time period or return of any prize/prize notification may result in disqualification and an alternate potential winner will be selected in a random drawing from the remaining eligible entries received. Acceptance of prize constitutes permission to the sponsor and its agencies to use winner's name, city, state, likeness, voice, biographical information and statements made by winners for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, unless prohibited by law. By accepting prize, winner agrees to hold sponsor(s), their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. By entering this promotion, entrant waives all rights to claim punitive, incidental and consequential damages, attorney' fees or any damages other than actual out-of-pocket costs incurred to enter. By participating in this promotion entrants agree to be bound by the Official Rules and the decisions of the judges. Sponsors are not responsible for incomplete, lost, late, damaged, illegible, misdirected entries, for technical hardware, software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit a user's ability to participate. Sponsors reserve the right in its sole discretion, to cancel, suspend or modify the sweepstakes (or any portion thereof), or to disqualify any implicated entrant(s), if any fraud, virus, actions by entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the sweepstakes, as determined by Sponsors in its sole discretion. In the event of cancellation, Sponsors reserve the right, at its sole discretion, to award the prizes not already awarded to an alternate winner in a random drawing from among all eligible entries received up to the time of the event or action warranting such cancellation. In the event this sweepstakes is cancelled prior to the stated end date, a notice will be posted at http://www.ivillage.com/home/challenge/pages/0,,205975_417297,00.html. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In the event of such a dispute or in the event a potential winner entered via internet and a dispute arises regarding specific individual entitled to receive prize, entries made by internet will be declared made by the authorized account holder of the email address submitted at the time of entry and any damage made to the web site will also be the responsibility of the authorized account holder. "Authorized account holder" is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this sweepstakes.
5. WINNERS LIST: For names of winners, available after April 15, 2004 send a self-addressed, stamped (#10) envelope to: Martex Community Challenge Sweepstakes Winners, 500 Seventh Avenue, 14th Floor, New York, NY 10018 to be received by May 15, 2004. (VT Residents may omit return postage)
6. SPONSORS: iVillage Inc. ("iVillage") 500 Seventh Avenue, 14th floor, New York, NY 10018, and WestPoint Stevens 1185 Avenue of the Americas, New York, NY 10036.
NO WARRANTIES: Sponsors make no warranties covering any of the prizes furnished as part of this Sweepstakes.
GOVERNING LAW: This Sweepstakes and the rights and obligations of the Sponsors and participants will be governed by and controlled by the laws of the State of New York, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of New York, County of New York. The parties consent to the jurisdiction of the state courts of New York and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Sweepstakes.
PRIVACY: Winners' name and contact information will be shared by iVillage with Sponsors in order to contact winner for the purpose of fulfillment of prizes. Information supplied by non-winning entrants will be shared by iVillage with Sponsors for remarketing purposes only if the entrant has opted in to receive more information from specified Sponsor on the entry form by checking the box next to the corresponding copy.
